South African Business Visa: Key Requirements

Business Visa

If you’re looking to start a business or invest in an existing one in South Africa, the Business Visa is your gateway. This visa allows foreign nationals to establish or expand businesses within the country, provided they meet specific requirements. Unlike investor visas in other countries, the South African business visa process has some unique elements tailored to the country’s economic goals.

Let’s break down the key requirements and documents needed for obtaining a Business Visa in South Africa.

General Requirements

  1. Business Setup or Investment
You must either establish a new business or invest in an existing one in South Africa.
  2. Financial Proof
Provide a certificate from a qualified accountant (SAICA or SAIPA registered) confirming that you have the necessary funds to invest, as determined by the Minister of Trade and Industry.
  3. Employment Quota
At least 60% of your employees must be South African citizens or permanent residents. Proof of this must be submitted within 12 months of receiving the visa.
  4. Business Registration
    You need to register with:
    • South African Revenue Service (SARS)
    • Unemployment Insurance Fund (UIF)
    • Compensation Fund for Occupational Injuries and Diseases
    • Companies and Intellectual Properties Commission (CIPC)
    • Relevant professional bodies (if applicable)
  5. Department of Trade and Industry Recommendation
A letter from the Department of Trade and Industry confirming the feasibility and national interest of your business must be included.

For Existing Business Investments

If you’re investing in an already established business in South Africa, you’ll need to submit additional documents:

  • Financial statements for the previous year
  • Proof of investment and meeting the employment quota
  • Registration proof with SARS, UIF, and other relevant bodies
  • Recommendation letter from the Department of Trade and Industry

Visa Duration and Renewal

The visa is valid for up to three years, with the possibility of renewal. You must submit proof from the Department of Labour within 12 months confirming that 60% of your workforce consists of South African citizens or permanent residents.
